Comparing wife with other women is cruel: HC

Kochi: The High Court has said that the constant jabbing that his wife is not up to his expectations and comparing him with other women is cruel and no wife can be expected to bear this. A division bench comprising Justice Anil K. Narendran and Justice C.S. Sudha said this while rejecting the husband’s appeal against the Etumanoor family court order granting divorce on the wife’s application.

The complaint of the young woman was that they had been together for only 40 days, there was no physical relationship and her husband was physically and mentally cruel. Both of them got married on January 17, 2009. On November 2 that year, the woman filed for divorce. Both the MCA graduates were software professionals.

A few weeks after the marriage, the woman says that her husband told her that the girl he imagined was not as beautiful and that he had married her because of her mother’s pressure. It was also informed that the husband had expressed resentment in the beginning. He used to get angry if he got a message from his male friends on his phone. He spoke in offensive language.

The court judged that the relationship between the two parties was broken beyond repair. The court said that if the court does not pay attention to this fact, it is harmful to the society and harmful to the interest of the parties.

It is not necessary to prove that the mental cruelty caused the ill health of the complainant. The court held that cruelty does not necessarily involve physical torture, but includes conduct that causes mental anguish and torture.
